These Terms and Conditions (hereinafter, “Conditions”) apply to all users or customers of site Ginova.pt (hereinafter referred to as User(s)) and, as well, any transactions of a commercial nature carried out through its online store.
Terms and conditions
1. Contract Proposal
The contractual proposal regarding the purchase and sale of products marketed on this website is intended only for persons of legal age, with full capacity to be responsible for the commitments resulting from the purchase and sale of the products marketed. The acceptance of these Conditions by the User is carried out in his/her personal name. When placing orders through the Online Store, the User declares that he is over 18 years of age, guaranteeing that he has full legal capacity and the necessary powers to carry out this acceptance. If the User does not agree with these Conditions, he/she should not access the website, nor the associated features and services. The completion of any and all purchases through the Online Store depends on the acceptance of these Conditions.
Ginova may at any time update, modify or replace, in whole or in part, these Conditions or the policies associated with them. The User will be responsible for periodically checking the occurrence of any changes. The use of the site is governed by the conditions present at each time of access.
2. Use of the Site
By using this site and/or purchasing any product in the online store, the User is bound by these Conditions and the remaining policies that govern the use of the site (namely, Privacy Policies and Cookies). Ginova requests you to carefully read the Conditions and associated policies before using this site.
The user may not use the site and associated features or services for illegal and/or illicit purposes.
Ginova is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or the provision of services to the Users.
Under no circumstances can Ginova (and/or its representatives or collaborators) be held liable for any damages that arise, in any way, from the malfunction of this website, regardless of the time in which such malfunction continues, or for any damage caused by the reproduction, use or exploitation of the website that violates the provisions of these Conditions.
Ginova reserves the right to modify at any time the information and commercial offer presented on: products, prices, promotions, commercial conditions and services. Ginova has the exclusive right, unilaterally, at any time and without notice, to suspend or terminate, partially or totally, temporarily or permanently, access to the website, in particular in management, maintenance , repair, alteration or modernization.
Violation of the provisions of the Conditions by the User constitutes grounds for its resolution by Ginova, which reserves the right, at any time, to terminate the use of the website and its respective functionalities and services by the User in question, with or without notice to the User. In any case, the breach of these Conditions by the User, and regardless of whether or not they are resolved, gives Ginova the right to be compensated for all damages resulting therefrom.
The User undertakes not to attack the website in any way, namely through a denial of service attack or a distributed denial of service attack. Non-compliance may imply the practice of various crimes provided for and punished in the personal data protection legislation and cybercrime law, that will be duly reported to the competent authorities.
Access to the site is not subject to registration. However, in order to place an order, User registration will be required.
To register, you must create a User account, providing an email address and password. If you wish to place an order, you will be asked for the following personal data: name, address, postal code, city and telephone contact. The user may change, update or remove the data provided at any time.
After registering and in subsequent accesses, it will only be necessary to identify yourself with the email address and the respective password, indicated when creating the User account.
The User is responsible for the authenticity of the data provided at the time of registration. The User will be solely and exclusively responsible for any false or inaccurate statements he makes, as well as for all activity that takes place on his account, and Ginova does not have any obligation to monitor the contents or the (non)compliance with any User's responsibilities, namely towards other Users or towards national authorities.
Ginova does not have access to or knowledge of the password defined by the User, and the User is responsible for ensuring its confidentiality and guaranteeing its safekeeping and good use, as well as complying with good security practices from your account. Ginova cannot be held responsible for damages resulting from the loss or misuse of the password defined by the User.
4. Place an Order
To place an order, you must add the desired products to your shopping cart, selecting the size and color. After selecting, click on "Checkout" and log in with your email address and password. If you do not yet have a customer account, you will have to create it (see more information in 3. Registration).
All products available on the Ginova website are represented with photographs and an indication of its essential characteristics.
Ginova makes every effort to ensure that the information presented and associated photos are up to date and free from errors or color variations. Without prejudice, whenever these occur, it will correct them as soon as possible.
Ginova may change, delete or move any product information on the site at any time, without notice, regarding prices, promotions, offers, commercial conditions and services.
The images are illustrative and may not correspond strictly to the actual appearance of the products, so the User must read the information provided on the website about the essential characteristics of each product. In case of doubt, you can contact Ginova in order to obtain additional information.
All products for sale on the site are subject to existing stock. Ginova is not obliged to supply products that are unavailable. Whenever there is any unavailability of any ordered products, Ginova immediately informs the User, refunding the respective price within 1 business day.
The price of the products will be as stipulated on our website, except in the case of an obvious error. In case of a manifest error in the price, Ginova immediately informs the User, giving him the option to confirm his order at the correct price or cancel it. If it is not possible to contact the User, we will consider the order as canceled and all amounts paid will be refunded in full.
The prices and products available on the website are valid for orders in an online store and purchases made in stores. physical.
The prices shown include VAT at the legal rate in force in Portugal. To these prices will be added the applicable postage depending on the destination.
The prices shown can be changed at any time, and any changes will not affect orders for which payment has already been made.

The items will be sent after the customer sends us the respective original proof and the number of your order by email to firstname.lastname@example.org
The sending of the respective proof is mandatory.
For all orders made with payment by bank transfer, the customer will normally have 2 working days to make the payment. After this period, a message will be sent asking if there is still interest in the article, if the customer is no longer interested, the order will be canceled and the articles will return to stock.

In our site, your mobile number is requested, and a payment request is immediately sent to the respective number. The order is valid for 2 minutes only.

The Delivery times vary depending on the destination, with the following deadlines shown below:
Deliveries within 24 working hours, maximum 48 hours, by Registered Mail, in purchases with payment made before 3 pm and for items with immediate delivery.
Islands - Madeira and Azores
Deliveries between 5 to 10 business days by Normal Mail.
Deliveries between 2 and 3 business days by Registered Mail.
Deliveries between 5 to 10 working days by Registered Mail.
Delays may occur for any of the following reasons: Delays by carriers; Delivery difficulties to the recipient; Local or national holidays;
Orders are not shipped on Saturdays, Sundays and Local or National Holidays. All orders are sent with invoices or by e-mail document serving as proof of purchase.
Shipments are only made after payment confirmation.
9. Shipping charges
For Continental Portugal, in purchases of less than 80€, the value of 4€ of shipping will be added.
In the case of shipping to the Islands of Madeira and Azores, in purchases of less than 80€ will be added to the value of 4€ of shipping costs, if the customer selects the registered shipping method 3€ will be added to the postage value.
For shipments to other countries, the cost of postage varies depending on the country of delivery. The cost of shipping is automatically generated in the shopping cart process.
10. Store Pickups
We provide our customers with an in-store pick-up service at our stores in Torres Novas and Fátima. When choosing the shipping method, simply select "Store Pickup".

14. Data Billing
If making a purchase on the site the User must provide the following billing data: full name, telephone contact, billing address and NIF (optional).
The registration data will be requested from the User in the first purchase through the site, being saved for the purpose of future purchases. The User may choose to enter new data in subsequent purchases.
15.Impossibility of Delivery
If it is impossible to deliver your order due to the absence of a recipient, a postal order will be left for collection at the indicated CTT post. If the address shown is incomplete or incorrect, the order is returned to our warehouses and the customer will be contacted for reshipment.
16. Exchanges and Returns
Pursuant to DL n.º 24/2014, of 14 February, amended by Law 47/2012, of 28 July and by DL n.º 78/2018, of 15 October, Consumers, whose definition is provided for in referred to legal diploma, have the right to freely terminate the contract, up to 14 days after receiving the order, without any need for justification.
The right of free resolution may be exercised by the User for all purchased products or just for some of the products included in the order.
To exercise the right of free termination of the contract, the User must contact Ginova through the email email@example.com, informing that he wishes to proceed with the exchange or return. The user must return the item/s in question to Ginova's facilities, bearing any shipping costs.
The products must return in perfect condition and without signs of use, after checking the condition of the article, we will send the chosen article for exchange, or refund of the value.
If the customer has taken advantage of free shipping, the return will be the value of the product, discounting only the value of the shipping costs supported by us when sending the order. If the payment was made by PayPal, the 3% fee charged to us by the PayPal payment regulator will also be deducted.
Ginova reserves the right to withhold the refund as long as the products are not received or as long as the consumer does not present proof of their return, as well as the right to refuse the refund of a product that, having been returned , is not in the condition in which it was issued.
Refund will be made via bank transfer. The user will have to communicate the NIB so that Ginova can proceed with the refund.
Ginova guarantees the security of the User account in the expected and appropriate security measures for platforms such as this website and its online store.
18. Data Treatment
The User consents to the use of the information provided for contact whenever necessary, as well as to the provision, by Ginova, of his personal data (name, address and telephone contact) to the carrier in charge of the delivery of the ordered products.

Ginova is not bound by adhesion or legal imposition resulting from necessary arbitration, to any alternative consumer dispute resolution entity.
20. Reasons for Force Majeure
Ginova will not be responsible for any breach or delay of any of the obligations caused by events beyond our control.
The concept of Force Majeure shall include any act, event, failure to exercise, omission or accident that is beyond our control, including but not limited to the following:
General strike, or other forms of protest that significantly affect the country.
Disturbances of public order, riot, invasion, terrorist attack or terrorist threat, war (declared or not) or threat, or preparation for war.
Fire, explosion, storm, flood, earthquake, landslide, epidemic or any other natural disaster.
Inability to use public or private telecommunications systems.
Impossibility of using railways, sea, air, road or other public or private means of transport.
Government laws, decrees, regulations or restrictions.
Any obligations will be suspended for the period in which they occur, extending the deadlines to fulfill such obligations for a period of time equal to the duration of the Force Majeure Reasons.
