This site is run by Ribermanos, Lda. (hereinafter“Ginova”), limited society based on Rua Lieutenant Santana Lopes, Building Concorde, Block C, Store 4, Cave -2495-414 Cova da Iria, Fatima, Portugal, with the tax identification number 515002062.

These Terms and Conditions (henceforth“Conditions”) apply to all users or customers of the Ginova website. pt (hereinafter referred to as User(s)) and, well so, any commercial transactions carried out through your online store.

 

1. Contractual Proposal

The contractual proposal concerning the purchase and sale of products sold on this site is directed only to older people, with full capacity to be responsible for the commitments resulting from the purchase and sale of the products marketed. Your acceptance of these Conditions is made on your personal behalf. By placing orders through the Online Store, the User declares to be over 18 years of age, ensuring that he has full legal capacity and powers necessary to carry out such acceptance. If you do not agree to these Terms, you should not access the site, or the associated features and services. The realization of any purchase through the Online Store depends on the acceptance of these Terms.

At any time, Ginova may update, modify or replace, in whole or in part, these Conditions or policies that are associated with them. You will be responsible for periodically verifying the occurrence of any changes. The use of the site is governed by the conditions present at every moment of access.

The continued access and use of this site after the publication of any updates, modifications or replacements of the Conditions and associated policies, with the exception of the Privacy Policy, constitutes acceptance and agreement with such updates, modifications or replacements. Without prejudice to any changes to these Conditions, the Terms and Conditions in force on each order shall apply.

 

2. Use of the Site

By using this website and/or by buying any product in the online store, you are bound by these Conditions and other policies governing the use of the site (particularlyPrivacy and Cookies Policies). GinovaRequests attentive reading of the Conditions and associated policies before using this site.

You may not use the website and associated features or services for illegal and/or unlawful purposes.

Ginova is not responsible for damages arising from interference, interruptions, computer viruses, breakdowns or disconnections of the operating system that may temporarily prevent access, navigation or the provision of services to Users.

In no event may Ginova (and/or its representatives or collaborators) be liable for any damages arising, in any way, from the malfunction of this site, regardless of the time that such malfunction is prolonged, or any damage caused by the reproduction, use or exploitation of the site that transgresses the provisions of these Conditions.

Ginova reserves the right to modify at any time the information and commercial offer presented on: products, prices, promotions, commercial conditions and servicesGinova has the exclusive right, unilaterally, at any time and without notice, to suspend or terminate, partial or totally, temporarily or definitively, access to the site, in particular in management, maintenance, repair, alteration or modernization operations.

The violation of the terms of the Conditions by you constitutes the basis for your resolution by Ginova, which reserves the right, at any time, to terminate the use of the Site and its features and services by the User concerned, with or without notice to you. In any case, the violation of these Conditions by the User, and regardless of whether or not it operates to its resolution, gives Ginova the right to be compensated for all damages arising therefrom.

The User undertakes not to attack, in any way, the site, in particular through a denial of service attack or a distributed denial of service attackFailure to comply may implypractice of various crimes foreseen and punished in the protection of personal data and in the law of cybercrimewhatwill be duly denounced to the competent authorities.

 

3. Registration

Access to the site is not subject to registration. However, in order to place an order, your registration will be necessary.

To register, you must create a User account, mandatory indicating an email address and password. If you wish to place an order, the following personal data will be requested: name, address, postal code, location and telephone contact. You may change, update or remove the data provided at any time by the user.

After registration is completed and in later accesses, it will only be necessary to identify with the email address and its password, indicated when creating a User account.

The User is responsible for the authenticity of the data provided at the time of registration. You will be solely responsible for any false or inaccurate statements you provide, as well as for any activity that takes place in your account, and there is no obligation on Ginova to monitor the content or the (un) fulfilment of any responsibilities of the User, namely to other Users or to national authorities.

Ginova has no access to or knowledge of the password set by the User, and the User is entitled to ensure the confidentiality of the User and to ensure that they are kept and properly used, as well as to comply with the good practices related to the security of their account. Ginova may not be liable for damages arising from the loss or misuse of the keyword defined by the User.

 

4. Make an order

To place an order, you must add the desired products in your shopping cart by selecting the size and color. After the selection you must click on "Enter Purchase" and log in with the email address and their password. If you do not already have a customer account, you must create it (see more information in 3. Registration).

All products available on the Ginova website are represented with photographs and with indication of their essential characteristics.

Ginova makes every effort to ensure that the information presented and associated photos are updated and free of errors or color variations. Without prejudice, whenever they occur, you will correct them as soon as possible.

At any time Ginova may change, delete or move any product information on the site, without notice, related to prices, promotions, offers, commercial conditions and services.

The images are illustrative, and may not correspond strictly to the actual aspect of the products, so you must read the information provided on the site about the essential characteristics of each product. In case of doubt, you can contact Ginova in order to obtain additional information.

All products for sale on the site are subject to existing stock. Ginova is not obliged to provide products that are unavailable. Where the unavailability of any products ordered is found, Ginova immediately informs the User, reimbursing him of their price within 1 working day.

 

Five. Prices

The price of the products will be stipulated on our website, except in case of an obvious error. In case of a manifest error in the price, Ginova immediately informs you, giving you the option to confirm your order at the correct price or cancel it. If you are not able to contact the User, we will consider the order as cancelled and all paid amounts will be refunded in full.

The prices and products made available on the site are valid for online store orders and purchases made in physical stores.

Prices shown include VAT at the legal rate in force in Portugal. These prices will be added to the applicable ports depending on the destination.

The prices shown can be changed at any time, and any changes will not affect the orders for which the payment has already been made.

 

6. Gift Card

The value of the gift card can only be used in full.

The value of the gift card cannot be returned.

In case of return of purchases made with gift card, the value will be returned in discount voucher.

 

7. Payments

Payment shall be made through one of the available forms of payment, such as:

Transfer banking or direct deposit.
Once the order is completed, you will be sent an email informing the amount to pay. The NIB to which the transfer must be made will be:

The articles will be sent after the customer sends us their original proof and the number of your order by email to general@ginova. pt
The submission of the respective proof is mandatory.

For all orders made with bank transfer payment, the customer will have 2 business days to make the payment. After this period, a message will be sent to question if there is still interest in the article, if the customer is no longer interested, the order will be cancelled and the items will return to stock.

Your mobile number is requested on our site, and a payment request is immediately sent to the respective number. The order is valid only for 2 minutes.

 

Eight. Promotions

All promotions made in products may be changed without any notice. Promotions will be available weekly or monthly until stock break.
All promotions on the site are in effect from 01/07/2025 until 30/07/2025.

 

9. Shipping

The User shall indicate the desired delivery mode and their data (name, address, postal code, locality and telephone contact), so that Ginova may inform the carrier responsible for the delivery of the order.

The delivery times vary depending on the destination and the following deadlines are given below:

Continental Portugal
Delivery within 24 hours, maximum 48h, by Registered Mail, in purchases with payment made until 15h and for items with immediate delivery.

Islands - Madeira and Azores
Delivery between 5 to 10 working days by Normal Mail.
Delivery between 2 to 3 business days by Registered Mail.

Foreign
Delivery between 5 to 10 business days by Registered Mail.

Delays may occur for any of the following reasons:Conveyor delays; Delivery difficulties to the recipient; Local or national holidays;

Orders are not shipped on Saturdays, Sundays and Local or National HolidaysAll orders are sent with invoices or by e-mail document serving as proof of purchase.

Shipping is only made after payment confirmation.

 

10. Ports Collection

For mainland Portugal, in purchases less than 50€ will be added the value of 5€ shipping with the CTT Expresso carrier.

It is up to the customer in the purchase process to choose the desired carrier, in the "3 Shipping Method" tab.

In the case of shipment to the Madeira and Azores Islands, in purchases less than 50€ will be added the amount of 5€ of shipping charges if the customer selects the registered shipping method adds 3€ to the value of the sizes.

For foreign shipments the value of the ports varies depending on the delivery country. The value of the ports is automatically generated in the shopping cart process.

 

11. Agricultural products in Loja

We provide our customers with a pick-up service in store, at our stores in Torres Novas and Fatima. In the act of choosing the sending method simply select "Advantage in Store".

14. Cookie Use Policy

Our website uses cookies for various reasons. We use "cookie" technology and IP addresses to obtain non-personal information from visitors and to provide our registered visitors with the best personalized online experience.

15. Billing Data

If you make a purchase on the site, you must indicate the following billing data: ncomplete ome, telephone contact, billing address and NIF (optional).

Registration data will be requested to the User in the first purchase through the site, being stored for the future purchase effect. You may choose to enter new data in later purchases.

 

16. Impossibility of Delivery

If it is impossible to deliver your order by the absence of a recipient, a postal voucher will be left for collection at the indicated CTT post. If the address presented is incomplete or incorrect, the order is returned to our warehouses and the customer will be contacted for reference.

 

17. Exchanges and Returns

In accordance with DL No 24/2014 of 14 February, as amended by Law 47/2012 of 28 July and DL No 78/2018 of 15 October, Consumers, whose definition is provided for in the said legal degree, have the right to freely resolve the contract, up to 14 days after receipt of the order, without any justification.

The right to free resolution may be exercised by the User for all products purchased or only for some of the products included in the order.

In order to exercise the right to free-resolution of the contract, you must contact Ginova through the general email@ginova.pt, stating that you wish to exchange or return. The user must return the article/s in question to the Ginova installations, supporting any shipping costs.

Products must return in perfect condition and without use marks, after checking the status of the article we send the item chosen for exchange, or refund the value.

If the customer has enjoyed the free shipping packages the return will be of the value of the product discounting only the amount of shipping by us supported when sending the order. If the payment has been made by PayPal, the 3% fee will also be deducted from us by PayPal.

Ginova reserves the right to retain the refund as long as the products are not received or as long as the consumer does not present proof of their return, as well as the right to refuse the refund of a product which, having been returned, is not in the conditions under which it has been dispatched.

The refund will be made via bank transfer. You will need to communicate the NIB so that Ginova can refund.

 

18. Security

Ginova guarantees the security of your account in the security measures expected and appropriate to platforms such as this website and its online store.

 

19. Data Treatment

By using this website, you acknowledge that your personal data will be processed by Ginova, identified above, declaring that all the information or data provided is true. Ginova may not be held liable for the inaccuracy of the information made available by the Users on the site, and is fully responsible for its accuracy, completeness and update. All information or personal data provided by you will be processed in accordance with the information set forth in the Privacy Policy and in the Cookies Policy.

You consent to the use of the information provided for contact where necessary, as well as to the provision by Ginova of your personal data (name, address and telephone contact) to the carrier in charge of the delivery of the ordered products.

Ginova is not bound by adhesion or legal imposition arising from necessary arbitration, to any alternative resolution entity of consumer disputes. 

 

21. Motifs of Force Major

Ginova will not be responsible for any failure to fulfil or delay some of the obligations which are due to events outside our control.

The concept of the Force Major must include any act, event, failure in the exercise, omission or accident that is outside our control, including, among others, the following:

  1. General strike, or other forms of protest that significantly affects the country.

  2. Public order disturbances, revolt, invasion, terrorist attack or terrorist threat, war (declared or not) or threat, or war preparation.

  3. Fire, explosion, storm, floods, earthquake, collapse, epidemic or any other natural disaster.

  4. Impossibility of using public or private telecommunications systems.

  5. Impossibility of the use of railways, maritime transport, air, road or other public means, or private transport.

  6. Laws, decrees, regulations or restrictions of the Government.

Any obligations shall be suspended during the period during which they occur, extending the deadlines to fulfil such obligations for a period of time equal to that of the duration of the Major Force Motives.
