Purchasing and Using the Ginova Platform

This Ginova Platform Purchase and Use Policy (hereinafter “Policy”) governs the terms and conditions applicable to the acquisition of goods and services through the online platform operated by Ginova, as well as the use of its marketplace by third-party consumers and sellers.

This document is prepared in accordance with the provisions of Decree-Law No 24/2014 of February 14 (transposing Directive 2011/83/EU, with the changes introduced by Directive 2019/2161/EU), Consumer Protection Law and other applicable national and Community legislation.

 

1. Definitions and Parts Contractors

For the purposes of this Policy, it is understood by:

Consumer – natural person acting for purposes that are not included in their commercial, industrial, craft or professional activity;

User – anyone who accesses or uses the Ginova platform;

Marketplace – digital space operated by Ginova where own products and partners are available;

Partner / Third Seller – singular or collective person who sells products on the Ginova platform through the marketplace;

Product Ginova – well marketed directly by Ginova;

Product Marketplace – well marketed by a third-party seller on the Ginova platform;

Economic Operator – the supplier of goods or service provider, as defined in applicable law.

 

2. Application scope

This Policy applies to all transactions carried out on the Ginova platform, distinguishing between direct product sales operations by Ginova and intermediation operations within its marketplace, in which Ginova acts as an intermediary between the consumer and the partner.

Ginova provides customer support and mediation with partners. The final responsibility for compliance with the contract is the partner identified at the time of purchase.

 

3. Platform Functionality

The Ginova platform allows the acquisition of own and partner products.

In the case of marketplace products, Ginova acts as a mere intermediate, ensuring the availability of digital space and payment processing.

 

4. Conditions of Purchase

The ordering process runs exclusively through the Ginova platform.

By placing the order, the consumer confirms the express acceptance of these terms.

Acceptance of the order is subject to confirmation of payment and stock availability.

The customer can include in the same cart Ginova products and marketplace products from different partners. In these cases, a separate shipment will be carried out by each seller, each shipment being subject to the respective conditions present in this policy and on the respective product page.

 

Five. Shipping Prices and Costs

Prices are shown in euro and include VAT at the legal rate in force, unless otherwise stated.

Transportation costs will be calculated and presented before the purchase is finished, and there may be free shipping campaigns.

 

6. Delivery times and modalities

Deliveries are made to Continental Portugal, Autonomous Regions, European Union and outside the EU.

The delivery of the marketplace products is made directly by the customer partner.

The delivery times are indicated before the purchase is completed. When it is not possible to indicate an exact deadline, a maximum period will be indicated. The exact delivery time will be communicated in the order confirmation email. The deadlines only begin after confirmation of payment.

If there is any delay in delivery due to exceptional circumstances (such as adverse weather conditions, logistical problems or other unforeseen), the customer will be informed by the partner as soon as possible, with a new delivery estimate if applicable.

 

7. Payment

Payment methods made available on the platform are accepted at the time of purchase.

The processing is done by Ginova which will confirm to the customer the receipt of the payment.

 

Eight. Faturation

In the case of Ginova products, the invoice will be issued directly by Ginova.

For marketplace products, the invoice will be issued by the respective third party seller.

 

9. Guarantees and Complaints

The legal system of the guarantee of conformity of the goods provided for in Decree-Law No 84/2021 applies.

When it comes to marketplace products, the responsibility for warranty is of the partner and the complaints should be forwarded directly to these.

 

10. Right of Free Resolution

The consumer has a period of 14 days to exercise the right of free resolution, in legal terms, counted from the receipt of the good.

 

11. Returns

Ginova product returns are guaranteed by this.

In the event of a defect or misconformity, GINOVA ensures the repair, replacement or refund under the law, assuming, where applicable, the costs of the return.

In the case of return by exercise of the right of free resolution, the costs are borne by the customer, unless otherwise stated.

The returns and exchanges of marketplace products should be treated directly with the seller.

12. Responsibility of Ginova

Ginova will be solely responsible for direct sales and services provided as an intermediary, not taking responsibility for the execution of contracts concluded directly with partners.

 

13. Personal Data Protection

The processing of personal data is governed by the Ginova Privacy Policy, prepared in accordance with Regulation (EU) 2016/679 (GDPR) and available for consultation here.

 

14. Dispute Resolution

Consumers can use the relevant Consumer Arbitration Centre or the European Litigation Resolution Platform: https://ec.europa.eu.int. me/consumers/odr

 

15. Provisions Finals

Ginova reserves the right to change this Policy at any time by publishing the new version on its platform.

In the event of a dispute, the Portuguese law is applicable and the jurisdiction of the district of Guimarães, except for an imperative legal provision on the contrary.
